AIRCRAFT RENTAL AGREEMENT

Rental of aircraft conveys acceptance of all terms and conditions of the rental agreement below

  • Aircraft are for rent ONLY for flight training and with a Certified Flight Instructor that has been signed off with current flight review and endorsement. by Kevin Alderman and approved in our system.  New CFI check out flights will be scheduled through Jennie.Flight instructors may direct students to our site to submit new user account and complete set up.. CFIs are encouraged to carry their own insurance as aircraft are for rent by student only with CFI as PIC until signed off for solo in Lark only
  • All Flight instructors must be a member of HoldShort/Aviation Services of TN with all credentials up-to-date for a student to rent the plane and a current/confirmed  check-out flight by the owner for approval and credentials
  •  Prior to rent of any aircraft,  students must provide proof of renters insurance-NO EXCEPTIONS
    • The aircraft are not insured for training.  All renters must provide proof of NON-OWNED aircraft rental insurance for liability and property damage.
  •   NO aircraft will be rented for personal usage.  
    • The Lark may be used for local flights to maintain currency.  Rate is $125/hr Prepay 10hours and get an 11th hour free
    • The Aztec will only be rented for any currency needs WITH a CFI and multiengine training with a CFI. Rate is $360/hr Prepay 10hrs with an approved CFI and get 11th hour free

AGREEMENT TERMS AND CONDITIONS ACCEPTED UPON AIRCRAFT RENTAL

This AIRCRAFT RENTAL AGREEMENT (hereinafter, the “Agreement”) is entered into  by and between AVIATION SERVICES OF TN (hereinafter, referred to as the “Owner”) and Renter(hereinafter referred to as “Renter”). This Agreement shall remain in full force and effect for a period of two (2) years from the Effective Date. Rental of aircraft is acceptance of all terms and conditions of this agreement

Owner hereby leases to Renter the aircraft designated available for rent on the following terms and conditions:

  • A.Pilot In Command. The Renter’s Certified Flight Instructor shall be the Pilot in Command of the aircraft at all times during the rental period unless the flight is being operated as a solo flight with a certified instructor endorsement only in the single engine Lark. The Aztec will only be rented for instruction with a CFI. All CFI’s will be approved for PIC/instruction after sign-off/check-out flight with the Owner and full credentials in Holdshort.com

B. Scheduling/Operating Rules. The Renter shall comply with the following rules:

(1) Prior to use of any of the OWNER’s aircraft, Renter shall reserve the aircraft via the OWNER’s designated scheduling website which is currently www.holdshort.com

(2) Renter shall return the aircraft at the scheduled time, weather and airworthiness permitting.

(3) No food or beverages are allowed in the aircraft except for water. If you need to bring snacks with you on a cross-country flight, they must be stored in a plastic container or bag that remains sealed during flight.

(4) No headsets, knee boards, cell phones, keys or other objects shall be placed on the glare shield above the instrument panel. This can scratch the interior of the aircraft.

(5) Renter will properly secure the aircraft after each flight. This includes installing the control lock in the yoke; installing the pitot cover on the pitot tube; tying the wings and tail securely; chocking the nose wheel; and installing the window cover, if provided. Failing to properly secure the aircraft will result in a $50 fee to the renter and responsibility for any damages caused to the aircraft or other property.

(7) The Renter shall be responsible for the rented aircraft at all times during the rental period, and any extension thereof.

(8) One time and Short-term rentals will not be approved. The multi engine aircraft are ONLY for instruction with a CFI and currency every 90 days will occur WITH a CFI. No overnight rentals of any aircraft are permitted

(9) ALL RENTERS MUST PROVIDE Renter’s Insurance proof emailed to Aztec4558p@gmail.com

(10) Owner has full discretion for approval/declination of any renter. 

C. Ownership of Aircraft. Renter acknowledges and agrees that the aircraft is the property of OWNER.

D..Pre-Flight Inspection. Renter acknowledges that prior to each flight, including any intervening legs, the Renter inspected the aircraft and found the aircraft to be in good mechanical condition and airworthy. The Renter further acknowledges that prior to each flight, including any intervening legs, the Renter performed all pre-flight inspections, calculations, observations and tests as indicated in the manufacturer’s Pilot Operating Handbook and/or manual.

E. Amounts Due from Renter to OWNER. Renter will  arrange to prepay for rental or at the conclusion of the rental through VENMO, CASHAPP or may leave a check  if credit card payment is preferred, a 3.5%fee for convenience is added to rental cost. Any rental charges not paid after two flights will be automatic termination of rental ability. After each rental and upon demand, renter shall pay to OWNER the following:

(1) Service and time charges computed at the applicable posted rates until the aircraft is returned to the OWNER. Posted rates are located on Holdshort.com but are $125/hr for the Lark Aero commander and $360/hr for the Aztec

(2) the cost to repair any damage to the aircraft, its components, parts and equipment, that is caused by the Renter; and

(3) all parking, tie-down, and hangar charges incurred until the aircraft is returned to the OWNER; and

(4) pilot flight time expense and aircraft flight time charge if the aircraft is abandoned away from SRB(Upper Cumberland) Smyrna, or MBT (Murfreesboro Municipal) airports

F. Alterations, Modifications & Repairs. The Renter shall not modify, alter, tamper with, repair or attempt to make any repairs to the rented aircraft or any of its component parts. In the event of a malfunction, the Renter shall immediately communicate with the OWNER for instructions.

G. Aircraft Damage, Accident/Incident. Renter shall report to the OWNER as soon as practicable any damage to the aircraft, accident or incident.

H. Non-Approved Uses. The rented aircraft shall not be used for private flights, one time or short term rentals. The aircraft are ONLY for instruction at the direction of a CFI approved by OWNER and through holdshort.com and:

(1) By any person other than the Renter who entered executed this Agreement.

(2) Outside the limits of the Continental United States

(3) To carry passengers or property for compensation or hire.

(4) For any flight for which the Renter is not properly rated or certified.

(5) For instructional flights with any flight instructor not approved by AVIATION SERVICES OF TN.

I. Flight Operations And Safety Rules. Renter shall comply with the following flight operation safety rules, emergency maintenance procedures and insurance provisions:

(1) Valid Pilot Certificate. At all times the Renter is in possession of a rental aircraft, the Renter shall hold a valid and current pilot certificate issued by the Federal Aviation Administration (FAA) with appropriate ratings. The Renter that scheduled the aircraft shall be the pilot in command with CFI, and shall not permit any other person to operate the aircraft during the rental period except for the CFI. The Renter shall fly the aircraft from the left seat.

(2) Currency. Renter must possess evidence of a current FAA flight review (or, if the Renter is a student pilot, all applicable solo endorsements), a valid FAA medical certificate, and an aircraft checkout by an AVIATION SERVICES OF TN approved CFI. To maintain scheduling privileges the Renter or CFI must: (a) act as a Pilot in Command (PIC) at least once every 90 calendar days in an aircraft for which the OWNER has provided a rental checkout; and (b) completed a proficiency review with a AVIATION SERVICES OF TN instructor once every 365 days. If the Renter has not met these requirements, the Renter shall have their scheduling privileges suspended pending approval of the Owner. This may require proof of recent flight experience and/or an additional aircraft checkout.

(3) Preflight Inspection. Renter will personally conduct a preflight inspection of the aircraft as prescribed by the manufacturer.

(4) Weather. Renter shall operate the Aero Commander aircraft only in VFR conditions, the Aztec can be operated IFRif the renter is instrument rated and current per FAR 61.57.

(5) Take-off and Landing Area. No take-off or landing shall be made on any area other than the runways of an airport designed, constructed, maintained, and used as an airport with paved runways of no less than 2,500 feet without express written permission of the OWNER

(6) Compliance With All Laws. The Renter will comply with all applicable local, state and federal ordinances, regulations and statutes.

J. Maintenance(1) Any concerns with the aircraft during operation relating to instrumentation or mechanics can be reported on holdshort.com and you may call and leave a message at 305-849-4415

(2) If there are any concerns with the aircraft during operation and it needs to be left at an alternative airport, call Kevin Alderman (239-896-7576) immediately and if he cannot be reached, call Jennie Alderman (305-849-4115). Leave a message please if we do not answer and secure the aircraft at the alternate field

(3) Do not authorize any repairs to be made to the aircraft without express written permission from the OWNER. The failure to do so may result in the Renter being responsible for the charges.

K. Renter’s Insurance

Renter must obtain and provide a copy of renter’s insurance for liability on the aircraft. AOPA, AVEMCO or EAA are possible options

L. Waiver & Release. Renter hereby waives, releases and discharges the OWNER, and all of its officers, directors, members, employees, instructors, agents, and volunteers from any and all liability for any damages, injuries or death arising out of or related to the use of the rented aircraft including any claims for negligence.

M. Assumption of Risk. Renter hereby acknowledges and understands that operating airplanes and being around airplanes involves risks. Serious injury or death can result from many causes, including but not limited to airplane crashes, falls, pilot error, ground crew error, engine or mechanical failure, negligent maintenance, defects in runways, interference by birds and other objects, weather conditions, contaminated fuel, or hard or forced landings. Injuries could include, but are not limited to, minor injuries such as bruises, scratches and sprains; major such as eye injuries, broken bones and concussions; or catastrophic such as paralysis, severe burns, or death. I assume all risks and full responsibility for any injury or death arising from taking part in any activity/flight.

N. Notice of Insurance Coverage. Any OWNER insurance coverage is only for OWNER and RENTER takes full responsibility for rental coverage of aircraft for any property damages or personal/bodily injury occurrences

AIRCRAFT PHYSICAL DAMAGE  INSURANCE IN FAVOR OF THE RENTER IS NOT MAINTAINED. Renter expressly acknowledges that the Renter is not an “insured” for any injuries or damage to the aircraft under any insurance contract or policy in the name of or for the benefit of the OWNER and that the Renter is personally responsible for any injuries to persons including the renter and all damages to the aircraft or other property as a result of operation of the aircraft that occurs during the rental period. At the sole discretion of the OWNER, in the event of damage to the rented aircraft, the OWNER will submit a claim to renter’s insurance. Any balance for damages not paid by the Renter’s insurance will be the sole liability and responsibility of renter.

O. Venue. The parties hereto agree that venue of any lawsuit arising out of or related to this Agreement, shall be exclusively in a court of competent jurisdiction in White County, Tennessee.

P. Waiver of Jury Trial. The parties hereto agree to waive trial by jury for any dispute arising out of or related to this Agreement.

Q. Time for Reflection. The Renter hereby certifies that prior to entering into this Agreement, the Renter has read all of the terms contained herein; fully understands each of the terms contained herein; has had the opportunity to consult with an attorney of Renter’s choosing; and has had ample time for reflection and enters into this Agreement voluntarily.

R. Severability. If any term of this entire Agreement is to any extent illegal, otherwise invalid, or incapable of being enforced, such term shall be excluded to the extent of such invalidity or unenforceability; and all other terms hereof shall remain in full force and effect.

S. Suspension of Renter’s Privileges. The Renter hereby acknowledges and agrees that the OWNER in its sole discretion may at any time and for any reason or for no reason at all suspend the Renter from operating and renting any of OWNER’s aircraft.

T. Modification. This Agreement shall not be amended or modified without a signed written agreement by all of the parties hereto.

U. Entire Agreement. This entire Agreement constitutes the final agreement between the parties and may not be contradicted by evidence of prior contemporaneous or subsequent oral agreements between the parties. There are no unwritten agreements between the parties.

PILOT HISTORY / DISCLOSURE

The Renter hereby warrants to the OWNER that the Renter’s answers to the following questions are true and accurate. The OWNER has relied upon the Renter’s truthful responses as an inducement to enter into this Agreement.

(1) Have you ever been convicted of driving under the influence or driving while intoxicated? If so, provide dates/locations of all convictions to aztec4558p@gmail.com

(2) Have you ever been involved in an aircraft accident or incident that resulted in damage to the aircraft or other property?
